We are planning to make a trip to Hyderabad, India along with my wife and my little baby boy. After reading all of your experiences, I am not sure which one should I opt for. We have an expired Visa on passport, planning to Use AP. As we are travelling first time with the little baby boy, I am looking for some hassle free flying. I stay pretty closer to Harrisburg, PA ...thanks

I recently traveled to Chennai. My H1b visa was expired in my passport and have an approved AP. I traveled through AA (Frankfurt) --> Gulf Airways (Bahrain) --> Madras and ultimately to Tirupati by Car, While going to India no one cared to ask for any documents not even in Frankfurt. By the way if you don't know this, you don't need a TV for Germany if you have AP. While coming back (I just came 2 weeks back), the officer at the Immigration counter looked at my passport and asked me how can i travel to US with an expired US Visa. I didn't give him my AP with my passport coz I was lazy to take AP from my bag. Finally I showed him my AP and he let me in. Now all the officers in India know about AP. They wont be surprised looking at the AP. In Bahrain I had a lay over of about 13 hours. Gulf Air gave me hotel accommodation. At the Bahrain immigration counter, the officer flipped 2-3 pages in my passport and didn't even care to look at my visa/AP. In Frankfurt, while boarding the AA flight to Dallas, the lady at the AA counter verified all my documents even my office badge. If possible carry your office badge/ID card with you. If you don't have one it should be OK because you are not required to carry and you can always tell them that you are not carrying. Since I showed her my AP, she took all my documents including my badge to her supervisor for the approval and finally gave me the boarding pass. In DFW the immigration was like a piece of cake. I was the second person in the queue. CBP officer after taking my finger prints took me to an officer (Secondary Inspection). The officer at the Sec inspection verified all my documents in his system and asked me to show my EAD. After checking my EAD, he said its not mandatory to carry EAD but safe. The whole process took less than 15 minutes. Let me know if you have any other questions.

I am still trying to talk the old employer. Is it such a big deal that they cant even write a letter of future employment for me? i told them that they are not obligated to hire me but they are scared that they are trying to show that they are in losses and that by filing for a GC and promising a future employment they will not be able to show that they are suffering losses.
Why is it so difficult and complicated?
I am losing hope in it.
There is no harm in trying the new application in parallel. Assuming your employer is paying for it/you can afford the extra fees. Time is critical as CIR might mess things up if you delay too much.

Got the email about being registered as a new permanent resident on Oct 8th. Thanks to SoP, caliguy, fatjoe and all others on the forum who helped / gave me support. I essentially learned that USCIS will not move quickly on their own, they need to be pursued just like any other govt. office in India. I give my time line below for an idea of what I did. If anyone is waiting still, I sincerely think that you should do all of POJ/SR/Infopass/Senator/Ombudsman.
Timeline:
Sept 1st - became current
Sept 5th - contacted NSC several times through POJ. Finally, a very nice lady told me that my case was not even assigned to an officer. Said that she will send in a request to the contractor to pull my case out and get it assigned to an officer.
Sept 11th - Case pulled out of storage area and moved to a smaller waiting room [got this info later, but this is what had happened]
Sept 13th: Opened SR.
Sept 18th - Infopass: Told me that my case was assigned to an officer on Sept 11th (which was wrong really) and that I should wait 30 days. Also told me that my FP were renewed on March 9th and all my checks were clear.
Sept 20th: Contacted Senator's office. Said they will send in inquiry.
Sept 25: Response to SR. Case under review. Wait 30 days.
Sept 27th: Letter from Senator saying my case was under review and I need to wait 30 days.
Oct 2nd: Contacted NSC again through POJ method. A nice lady, Terry, told me that my case was assigned to officer on Sept 30th. She said, "your case was pulled out of storage and put in a rather large holding area where it was till Sept 30th." Also confirmed that my FP was renewed and other checks were clear. Said, just wait, it will happen soon.
Oct 6th: Sent 7001 form to USCIS Ombudsman.
Oct 8th: Got decision email.
Learnings: Pursue your case as much as you can. Call NSC, but be polite. They are usually in good mood on Thu/Friday evenings and if you make some small talk, they will help you. I kept records of which NSC IO is rude and if they picked up the next time, I would just keep the phone down. In fact, the lady who helped me remembered me 'coz I managed to reach her 3 times. Dont just ask for status, say that you have called in the past and so far you know xxxx about your case. Some IOs are nice, some are rude. Nice ones actually tried to explain the entire storage area, holding area, supervisor supply chain to me. I think I kind of understand the process that happens at NSC just through these conversations now. Approach Ombudsman asap with form 7001. Call your Senator office and ask to speak to the immigration person. They are very understanding and will help you.

No one want to waits anymore (it's already 93 days :mad: ) AND no one want to participate in any action to speed-up the process or put more pressure on USCIS to correct their behavior (USCIS will come back and screw your case :) ). Please tell me what you wants. :confused: Either please don't complain and wait till your Check Cashed :D OR organise and do your part, take some action to put pressure on USCIS. Choice is yours. :D

Flying through Asian Countires is not an option for people residing in East Coast. I am travelling to India in the next week Via Amsterdam. I am told by the consulate that we do not need Transit Visas. My H1B Visa is expired and I am travelling on AP. Did any one hear differently?

This confirms what my travel agent told me .. I'm flying next week to India on NWA (JFK-Amsterdam-HYD) .. I will be travelling on AP with an unstamped H1B .. No Transit Visa required!

I have flown on Continental from Newark to Mumbai non-stop. The best international flight experience so far! I bought the ticket online at their website. Guess what! It was almost 60% the price of lowest price travel agents were quoting on other airlines!
The flight is a bit long lasting just under 15 hours. But, it leaves at around 8 PM. After an in-flight dinner, it is bedtime. People who have taken overnight bus journeys in India, this is not much different. If you can manage to sleep in that half sitting position (I cannot!) then it is that much better. You wake up, eat breakfast, spend 3-4 hours enjoying their inflight individual entertaintment unit, and soon it is time to land in Mumbai.
There is no hassle with food either. Indian veg is part of their standard offering. So, no hassle of ordering AVML and hoping that they will remember to serve it to you.
The down side:
1) The length - at 15 hours (16.5 hours during return), it can get too much.
2) The service is as bad as any US domestic flight.
3) If you do not live in Mumbai or Delhi, your journey would not end with this flight.
I see that more airlines are moving towards this long haul model with flights lasting over 12 hours. I think it is great, because we avoid all transit hassles, such as security, transit visa, etc., etc.
Soon, AI, Jet and Kingfisher are going to enter into this market. Hopefully more cities in India will connected to more cities in US this way.

We will make next week as a "WEEK OF ACTION". If you see my other thread ("can we send Pizza" thread) and many others, the common routine is to get many good ideas, but not much action.
We will gather as much support as we can till this weekend and at the same time make sure we consolidate the contact information at one place who to contact, and then starting next week, we can start sending out our message as loud as we can.
We must push for 5 years GC and 10 years Citizenship. I know how much painful it canbe for someone after 11 years waiting for GC, wheras others with 6-7 years in US applying for Citizenship. Not that they got it, but why we did not get it.
And we will focus on points how we can contribute in this crisis.
Others who are directly not benefited by this action:
Please note all your seniors will be out of the queues and you will get your numbers faster.

Why should USCIS approach oldest priority first? Well because that is how the law is. The law only affords you the initial set of numbers all the spill-over numbers from another category is supposed to be used in a FIFO manner.
You have made other comments about being cry-babies etc, I could respond to that in more than kind, but I will not, because I refuse to get distracted beyond sane arguments. And BTW: respect, not unlike trust, is to be gained, not asked to be followed.

I am a dependent of my husband's process - my PD is now current, is it possible to switch and have an I-485 application where I am the primary applicant and he is the dependent, so we do not depend on his company anymore?
I do not want to take anyone's else opportunity by getting another A#, just want to know if there is a way to switch the roles.

If that is the case you have legitimate reason to take this matter with your local congress man if their legal cannot clear them.
Follow the suggestions of experts in this thread. I suggest you to contact your local congressmen. They would definitely help as in my case they did to expedite EAD renewal.

Hi All,
I am on a business trip to Chennai and I was interviewed for my H1-B renewal on Dec 6th 2007, unaware of the PIMS as it was not mentioned anywhere on the website that it will take this long to receive the passport. I was granted my visa within few minutes but till date (Jan 1st, 08) I have not received my passport. Was interviewed at the Chennai consulate. It has been heights of frustration as I had to spend all my Christmas holidays and New years at Chennai with all my fly being in US. I was supposed to return to US on Dec19th had to postpone my tickets to Dec 24th and then to Dec 29th. Now finally I have cancelled my tickets as it was costing me $200 every time I modify my itinerary.The US consulate, Chennai keeps on extending the processing time from 3 to 7 to 10 and it has been 15 working days already now, but still no passport in hand. Last week on Friday (Dec 28th) got an email that it might take additional 7 working days, huh ! Good thing is my company is in Chennai so atleast I can go to work or else it would have been really painful.

1) The USCIS and State department are not communicating at all. This is not at all uncommon within gov't agencies as we all know.
The State Dep't released the bulletin perhaps without realising the full ramifications. Having heard from the USCIS..........hey hey hey what the F&^% are you doing? They may have realised over the last few weeks what a mess they have on their hands. Now they are trying to undo it.
2) Another possibility I can think of, is that this is a grand plan(heck I almost said grand bargain) concocted by the USCIS to get 485s OUT of the system as much as possible while minimising those that can get IN. Hence you might see in the coming few weeks thousands of approval letters all dated the 2nd of July. That will allow them to clear their backlogs of pre-approved, approvable cases and clean the slate fresh for the new fees structure/new quota in the new year. Some of you might remember they retrogressed to unavailable around this time 2 yrs ago. They do these weird things in the 4th quarter.
3) Of course the last option is their brains have the same IQ as that of any common critter that messes up your garden.
Pick your poison, it is all the same. I feel for everyone whose hopes were raised so high. It is truly inhumane of them. If they planned this, they should atleast have delayed the release of the July VB.

I got the I-485 approval/welcome notice from USCIS for myself and my spouse today. But the wierd thing is that my NSC online status still shows RFE response received and case pending (from 2008)...the welcome notice says I should expect to receive the card in 3 weeks...guess I am greened.
Anyone else face a similar situation?

I got the I-485 approval/welcome notice from USCIS for myself and my spouse today. But the wierd thing is that my NSC online status still shows RFE response received and case pending (from 2008)...the welcome notice says I should expect to receive the card in 3 weeks...guess I am greened.
Anyone else face a similar situation?

The 5000 minute limit is phrased as "consistent with residential use" term in the Terms and Conditions. CS is often clueless.

THe reason USCIS is showing low numbers for the reason that , no one will then raise the question for recpature. Looking at the numbers they will say, O, the numbers are so low, whats the need for recapture and we will be left hanging cold and dry.
