    VLDRAO does a good job of predicting but...I dont think EB2 I will be current in a year, try to understand, the visas might be there but the USCIS simply does not have the capacity to adjudicate so many cases. There will be a flurry of approvals in September when they reassign people from other departments to consume as much as they can of the existing quota, but the fact of the matter is that visas will still be wasted.

    It is naive to assume that EB2 will be current and all problems will be solved. think practically.

    As for EB3 if all the spillover is going to EB2 then ROW EB3 as a whole is getting increasingly backlocked which implies that there is less available for spillover for EB3 I/C. Watch out for more EB3 countries getting retrogressed in early 2009.

    If I am not wrong VDLRAO is predicting Eb2 will be current with in a year if USCIS continue horizontal spillover. What is wrong with you..

    Mine seems to be few of last applications entered in system during July 07 visa bulletin fiasco(rather fiesta). My Notice date 10/17. I have not seen July filer notice date, later than this...

    My notice date is 10/10. It seems cases are approved based on the notice date. My case was transferred from CSC to TSC. You are right that only few cases have Oct notice dates.

    Thought this was stupid idea about couple of years back, looks like its not that bad! Every one likes it and wants it!
    2 years back we did not think about the future. Just only about the GC and we forgot how many years we are living in this country...

    I am in also facing the same situation...My employer says, the attorney clubbed some applications into one box and sent it, and donot know which box my application is, hence no fed ex number. Hopefully it should he been reached by july 2nd...No Receipts No Checks cleared...waiting for Sept 30 to call USCIS (after 90 days of filing)...most probably my application would have received by R.MICKELS, Delivery date: Jul 2, 2007 9:01 AM. I have got a list of tracking numbers from the attorney, only this tracking number details shows 4 lbs...hence thinking that my application is clubbed in this one. This was sent to Nebraska service center, My I-140 approved from Texas on June 25th. CAdude, Can you add my details onto the list. The compiled list show the time stamps are very close....

    Folks,

    I sent the letters and also invoked the AC21 through a lawyer a month ago. However, inspite of all this, I see a new update for my 140 petition today -

    Application Type: I140, IMMIGRANT PETITION FOR ALIEN WORKER

    Current Status: Withdrawal Acknowledgment Notice Sent

    On November 5, 2008, we mailed a notice acknowledging withdrawal of this application or petition I140 IMMIGRANT PETITION FOR ALIEN WORKER. If you have not received the notice within 30 days of November 5, 2008, contact our customer service at 1-800-375-5283. If at some point in the future you wish to pursue the benefits provided by this application or petition, you must file a new application along with all applicable fees and evidence.

    I am not sure if this means that my 485 will be denied shortly...

    This could be a new status message by USCIS when 140 is withdrawn by employer. If I am not worng, the notice that they mailed out, will gop to employer and not you.

    Call customer service to know about ur 485. I am hoping it will be fine as you filed for ac21

    Recieved physical cards today.

    CPO - Aug 6th
    Post decision - August 13th
    Approval recieved in snail mail - August 11th
    Cards recieved - August 18th

    Thus the GC journey of 9 years and 8 months ends. Currently no difference in life it makes. May be when i travel GC may be of more help. (no AP H1B stuff to worry about)

    Good luck to all who are current and to all who are waiting. Hang in there. You will definitely get it.

    Pages 245 and 246 includes recapture clause

    From a quick glance, I see all the provisions talked about in various bills for EB category except for recapture of unused visas. Very broad markup.

    Nonimmigrant Visa Number: is this the contraol number of H1B stamping?
    From first stamping or last one?
    My last one I got from state department by mail. The 'psot' is mentioned as 'DEPARTMENT'. So if the control# from the last visa, then
    'Consulate Where Visa Was Issued' will be what? Department?

    FYI...I heard from some of my friends that Vonage is good as long as you are its customer. Once you call CS and tell them you are leaving...they play all sorts of dirty tricks.

    Thats the only reason I hate Vonage. Once you select the option to disconnect you will be in line 1 hr, then some one will come and ask you to hold till they pull up your record. You will be on hold for 20 mins and will be disconnected. This cycle will go on unless you are lucky. I had to try this 4-5 times...then I started hating their service. Otherwise they are good.

    Did anyone see any Soft LUDs on their 485 or old EADs before their approvals/RFEs?

    My PD is June 7 2006, not current. Yesterday, I had a soft LUD on my 485 and my first EAD. These two haven't seen any activity since early 2009, and I'm wondering if this means anything or if I'm reading into this a little too much.

    You still did not get it. Without evidence of discrimination it would be difficult to fight against... Forget this for a moment, in any law based battle you have to have a evidence. It is not that I do not want to fight or somebody do not want to fight. How could you make the base for fighting? This other guy, with his sheer luck (And with Capital One's stupidity) could get written evidence and so he has a valid base to fight against. And without evidence, whatever you write to whomsoever authirities, it would just be a blabbering. Even as one platform if IV decides to fight against this, IV team (Or lawyers whom we appoint) will ask the evidence first to make the case. Other thing, do not forget, what we could achieve in July 2007, the base was definately a first screw up from USCIS ( That is an evidence...). Once that screw up happened we could right away make it a reference and could make it a battle point.. Do you still understand or you do not want to understand?

    I do understand that without evidence you can't fight the conventional way or file a law suit. It would be difficult, if not impossible. I am not debating that. I never said it would be easy. Even with evidence (in case of Capital One), one can argue if thats a good enough base for fighting and whether it will do any good if the case is won. Thats not the point.

    What would you do if a recruiter or employer told you (verbal or writing) that it is their policy not to hire Indians? (I am just using India as an example).

    Regardless of written evidence, I would be inclined to do something about it. I am not saying that I will file a law suit. I would probably not even want to work for such an employer. But I will not be speculating that oh, there must be some loophole that allows employers to have such a policy; because many of them are saying that, it must be legal. I will not assume that they can do this under "Hire and fire" authority. We just seem to have a little difference in opinion about that. We agree on pretty much everything else. Thats all. And frankly, its good to have an opposing perspective on things.

    Now, if I hear from experts that my understanding of the discrimination laws is incorrect and that it is legal for an employer to say that they will not hire somebody with EAD, I'll just shut up. Until then, I will encourage people not to be quiet and to call the hotline, file a complaint, call the media, and pursue whatever means we have at our disposal to fight what we consider injustice and fight what we believe is discrimination as per the law.

    Are they interested in national security or just numbers of processed name checks? Why not create a special team to handle requests with the high number of "hits" as those are much more dangerous potentially for the national security?

    Has your I-485 been approved or you have got an RFE?

    Well I got RFE then within a week got Card Production ordered email then within 12 hrs got mail undelivered email..

    I have not replied to RFE yet.

    Contacted USCIS but *** they are telling talk to Post office :eek:
